§1. General Provisions

  1. These Terms of Service (hereinafter: “ToS”) govern the rules of using the website available at https://www.stablewatch.io/ (hereinafter: “Website”).
  2. The Website is operated and the services are provided by Stablewatch spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw, at Poznańska Street 16/4, 00-680 Warsaw, Poland, entered into the Register of Entrepreneurs of the National Court Register (KRS) under KRS number: 0001174918, NIP (Tax ID): 7011261860, with a share capital of PLN 20 000, contact@stablewatch.io (hereinafter: “Service Provider”).
  3. Every entity using the Website is considered a user (hereinafter: the “User”). The Service Provider makes these ToS available to Users free of charge on the Website.
  4. The services provided on the Website are not intended for minors (individuals under 18 years of age). By accessing and using the Website, the User declares and warrants that they are at least 18 years old.
  5. Website operates exclusively as an independent, educational, and analytical data aggregator. The core purpose of the Website is to provide Users with objective insights, articles, and real-time metrics concerning stablecoins and decentralized finance (DeFi) protocols. The Website is not a trading platform, brokerage, or exchange. The Users may contact the Service Operator by using the contact form available on the Website.
  6. By accessing the Website, the User agrees to comply with these ToS. All services provided on the Website are completely free of charge.
  7. Users who are consumers (natural persons using the Website for private purposes) are entitled to all statutory rights granted under Polish and EU law, including the right to withdraw from contracts etc. Any provisions of these ToS attempting to limit statutory consumer rights shall not apply to Users who are consumers.

§2. Electronic Services

  1. The Service Provider provides the following electronic services via the Website: providing access to the Website’s content, including articles, research, data, and the DeFi dashboard featuring yield metrics and risk profiles.
  2. The contract for the provision of the electronic service consisting of browsing the Website is concluded upon the User’s entry to the Website and is terminated at the moment the User leaves the Website.

§3. Technical Requirements

  1. In order to properly use the Website, the User must meet the following minimum technical requirements: a device with Internet access, an up-to-date web browser, and enabled execution of cookies.
  2. The Service Provider does not warrant that the Website will be uninterrupted, timely, secure, or error-free, and reserves the right to suspend or restrict access to the Website for maintenance, updates, or technical improvements without prior notice.
  3. The User is strictly prohibited from providing or uploading any content of an unlawful nature to the Website. The User is obliged to use the Website in a manner consistent with the law, good practices, and the provisions of these ToS.

§4. Disclaimers

  1. Website is strictly a data aggregator and research platform. The Service Provider does not provide crypto-asset services within the meaning of the Markets in Crypto-Assets Regulation (MiCA). The Service Provider does not provide custody, administration, or exchange of crypto-assets, nor does it offer crypto-assets to the public.
  2. All information, data, articles, risk profiles, yield metrics, and materials published on the Website are provided for informational and educational purposes only. Nothing contained on the Website constitutes financial, investment, legal, tax, or other professional advice.
  3. The cryptocurrency, decentralized finance (DeFi), and stablecoin markets are highly volatile. Past performance is not indicative of future results. The User acknowledges that any trading or investment decisions made based on the information provided on the Website are made strictly at their own risk.
  4. To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any direct or indirect damages, loss of capital or loss of profits, resulting from the use of or reliance on the Website’s data.
  5. While the Service Provider strives to provide accurate on-chain data and analytics, no warranties are made regarding the accuracy, completeness, or reliability of the data metrics presented. The User acknowledges that data errors may occur.
  6. The Website contains links to external decentralized applications, protocols, and third-party websites. The Service Provider does not operate, control, or endorse these platforms.
  7. The User acknowledges that interacting with third-party DeFi protocols involves inherent risks, including but not limited to smart contract failures, exploits, and hacks. The Service Provider shall not be held liable for any losses incurred by the User on third-party platforms linked on the Website.
  8. By accessing the Website, the User warrants that they are not located in, incorporated under the laws of, or ordinarily resident in any country or territory subject to comprehensive sanctions imposed by the European Union, the United Nations, or the United States (including OFAC sanctions).
  9. The User bears sole responsibility for complying with the local laws and regulations applicable in their jurisdiction regarding access to and use of cryptocurrency or decentralized finance information.
  10. The User is fully liable for any damages, losses, or costs incurred by the Service Provider as a direct or indirect result of the User’s breach of these ToS, unlawful use of the Website, or unauthorized distribution of the Website’s data.

§5. Intellectual Property

  1. All intellectual property rights to the Website and its components, including but not limited to its layout, graphics, user interface, software, databases, data aggregations, articles, research, and logos, are either the exclusive property of the Service Provider or the Service Provider holds the right to use and dispose of them on the basis of appropriate licenses, agreements, or legal permissions.
  2. The articles published on the Website are protected by applicable copyright laws.
  3. The User is granted a limited, personal, non-exclusive, non-transferable, and non-sublicensable license to access and use the Website and its content solely for personal, non-commercial purposes.
  4. The User shall not commercially exploit, resell, or distribute the data or content displayed on the Website. Furthermore, the User is strictly prohibited from:
    • using automated means, including bots, to systematically extract or harvest data from the Website without the prior, explicit consent of the Service Provider;
    • reverse-engineering, decompiling, or disassembling any part of the Website;
    • aggregating or mirroring the data provided by the Website to create a competing product, service, or derivative work.

§6. Personal Data Protection

  1. The Service Provider is the Controller of the personal data of the Website Users.
  2. Detailed rules regarding the processing of personal data, the purposes of processing, data retention periods, and Users’ rights are specified in the Privacy Policy available on the Website.

§7. Complaints

  1. The User has the right to file a complaint regarding the functioning of the Website and the electronic services provided under these ToS.
  2. Complaints should be submitted electronically to the contact@stablewatch.io e-mail address or through the contact form available on the Website.
  3. To ensure efficient processing, a correctly submitted complaint should contain at least: the User’s contact details, a detailed description of the problem or malfunction, the exact time of its occurrence, and the User’s expected resolution.
  4. If the data or information provided in the complaint is incomplete and prevents its proper consideration, the Service Provider reserves the right to request the User to provide additional details or clarifications before processing the complaint, provided this does not infringe upon the statutory rights of a consumer.
  5. The Service Provider shall consider the complaint and respond to the User within 14 days of its receipt. The response to the complaint will be sent to the e-mail address from which the complaint was submitted.

§8. Final Provisions

  1. The Service Provider reserves the right to amend these ToS for important legal, regulatory, or technical reasons. Any amendments to the ToS shall enter into force on the date specified by the Service Provider, which shall not be shorter than 14 days from the date of publishing the updated ToS on the Website. The continued use of the Website after the revised ToS take effect constitutes the User’s acceptance of the changes.
  2. Matters not covered by these ToS shall be governed by Polish law, in particular the Civil Code, the Act on providing services by electronic means, and the Consumer Rights Act.
  3. If any provision of these ToS is found to be invalid, illegal, or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
  4. The choice of Polish law does not deprive a User acting as a consumer of the protection granted to them by provisions that cannot be derogated from by agreement by virtue of the law of the country where the consumer has their residence.
  5. Any disputes arising between the Service Provider and a User who is not a consumer (including business entities, professionals, and corporate users) shall be settled by the common court having jurisdiction over the registered office of the Service Provider (Warsaw, Poland).
  6. A User acting as a consumer has the right to use extrajudicial means of dealing with complaints and redress. Detailed information regarding the possibility for a consumer to use these procedures and the rules of access to these procedures are available at the offices and on the websites of municipal consumer ombudsmen, social organizations whose statutory tasks include consumer protection, and the national competition and consumer protection authorities.
