Newsletter Terms and Conditions
§1. General Provisions
The following terms and conditions (“Terms and Conditions”) establish the rules of a newsletter service provided by Stablewatch (“Newsletter Service”).
The provider of the Newsletter Service is Stablewatch sp. z o.o. with its registered office in Warsaw, Poznańska 16/4, 00-680 Warsaw, registered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the capital city of Warsaw in Warsaw, 12th Commercial Division of the National Court Register under KRS number: 0001174918, NIP (Polish tax identification number): 7011261860, e-mail: contact@stablewatch.io (“Stablewatch”).
Stablewatch provides electronic services in accordance with the Terms and Conditions and applicable laws.
§3. Consumer’s right of withdrawal
A Subscriber who is a consumer may withdraw from the Newsletter Service Agreement without giving any reason within 14 days from the date of its conclusion.
To exercise the right of withdrawal, the Subscriber should inform Stablewatch of the decision to withdraw by an unequivocal statement, in particular sent by e-mail to contact@stablewatch.io or in paper form to: Stablewatch sp. z o.o., Poznańska 16/4, 00-680 Warsaw. The Subscriber may use the model withdrawal form attached as Annex 1 to the Terms and Conditions, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for the Subscriber to send the statement before the deadline expires. Clicking on the “unsubscribe” link within that period has the same effect.
Stablewatch shall confirm receipt of the withdrawal statement by e-mail without delay. As the Newsletter Service is provided free of charge, the withdrawal does not involve any costs for the Subscriber.
The provisions of this paragraph also apply to a natural person who concludes the Newsletter Service Agreement directly in connection with their business activity, where the agreement is not of a professional nature for that person, in particular in the light of the subject of their business activity disclosed in the Polish Central Register and Information on Economic Activity (CEIDG).
§4. Nature of the Informative Materials
The Informative Materials are provided for general information purposes only. They do not constitute investment, financial, legal or tax advice, an investment recommendation, or an offer or solicitation to buy, sell or hold any crypto-assets, financial instruments or other assets.
The Informative Materials are prepared on the basis of publicly available data and data from third-party sources, including onchain data. Stablewatch makes reasonable efforts to ensure that the Informative Materials are accurate, but does not guarantee that they are complete, accurate or up to date. The Informative Materials reflect the state of knowledge as at the date of their preparation.
Any decisions made by the Subscriber on the basis of the Informative Materials are made at the Subscriber’s own discretion and risk. Investing in crypto-assets, including stablecoins and onchain yield products, involves a high level of risk, including the risk of losing all invested funds.
Promotional content and content of Stablewatch’s partners included in the Informative Materials shall be marked as such. Stablewatch is not a party to any agreements that the Subscriber may conclude with Stablewatch’s partners.
The Informative Materials are protected by copyright. The Subscriber may use them for their own information purposes, including the internal purposes of the organisation they represent. Any other use, in particular reproducing, distributing or making the Informative Materials publicly available for commercial purposes, requires Stablewatch’s prior consent, except as permitted by mandatory provisions of law.
§5. Security
Using e-mail involves risks typical of electronic communication, in particular the risk of receiving messages impersonating other senders (phishing) and messages containing malicious software.
Stablewatch will never ask the Subscriber, in the Informative Materials or in any other message, to provide private keys, seed phrases or passwords, to connect a wallet or to transfer any funds. Any such message should be treated as an attempt to impersonate Stablewatch and may be reported to contact@stablewatch.io.
§6. Personal data
Subscribers’ personal data shall be processed by Stablewatch as data controller.
The detailed provisions regarding the processing of personal data, including the purpose and scope of processing, are included in the Privacy Policy (available to the Subscribers at the time of subscription and on the Website at https://www.stablewatch.io/privacy).
§7. Liability of Stablewatch
In case of improper performance of the Newsletter Service, Stablewatch shall be liable in accordance with the provisions of generally applicable laws, including those specified in the Civil Code.
§8. Complaint procedure
The Subscriber has the right to file a complaint regarding the electronically provided services referred to in these Terms and Conditions. The complaint may be submitted in particular by e-mail to contact@stablewatch.io or in paper form to: Stablewatch sp. z o.o., Poznańska 16/4, 00-680 Warsaw.
Stablewatch encourages the Subscriber to indicate precise information regarding the subject of the complaint, including: the Subscriber’s name, mailing address, e-mail address, pointing out the factual circumstances supporting the complaint. Indication of the above data will quicken the processing of the complaint. Indication is only a recommendation and does not affect the effectiveness of the complaint submission.
Stablewatch will review the complaint and respond to it no later than 14 days from the date of its receipt. If Stablewatch does not respond to the complaint within the stated period, Stablewatch shall be deemed to have considered the complaint as justified.
§9. Amicable dispute resolution
Stablewatch states that it will endeavour, as far as possible, to resolve amicably any disputes arising between Stablewatch and a Subscriber who is a consumer, due to the use of the Newsletter Service.
In the event of a dispute between a consumer and Stablewatch about a complaint submitted by the Subscriber, the Subscriber may use out-of-court complaint and redress procedures. The consumer may, in particular, apply for mediation or the consideration of the case by an arbitration court, or use the assistance of the district (city) consumer ombudsman.
Detailed information on the possibility for a Subscriber who is a consumer to use out-of-court ways of dealing with complaints and pursuing claims is available, among others, on the Polish-language websites of the Office of Competition and Consumer Protection at www.uokik.gov.pl, as well as on the websites of Provincial Trade Inspection Inspectorates (e.g. http://wiih.org.pl/index.php).
§10. Amendments of the Terms and Conditions
Stablewatch shall be entitled to amend the Terms and Conditions for reasons such as: change of law, change of collected data or change of provided Informative Materials.
The amendment of the Terms and Conditions shall become effective on the date stated by Stablewatch, which in each case shall not be sooner than 7 days from the date the new Terms and Conditions are made available to the Subscriber.
Amendments to the Terms and Conditions shall not affect the rights and obligations of the parties arising prior to such amendment.
Amendments to the Terms and Conditions shall be binding on the Subscriber if the Subscriber has not terminated the Newsletter Service Agreement within 7 days from the date of notification of the amendments. Statement of termination may be submitted by e-mail to contact@stablewatch.io, in paper form to: Stablewatch sp. z o.o., Poznańska 16/4, 00-680 Warsaw or by clicking on the “unsubscribe” link available in each e-mail sent with the Informative Materials.
§11. Final provisions
The contents of the Terms and Conditions are available to each Subscriber in the file available on the Website.
In the event that any provision of the Terms and Conditions is declared invalid or ineffective, the remaining provisions of the Terms and Conditions shall remain in full force and effect.
Any matters not addressed in these Terms and Conditions shall be governed by the generally applicable provisions of Polish law, in particular the Civil Code and the Act on the Provision of Electronic Services. Where the Subscriber qualifies as a consumer within the meaning of applicable law, the choice of Polish law shall not deprive such Subscriber of the protection afforded by the mandatory provisions of the law of the country in which the consumer has their habitual residence.
